General Terms and Conditions (GTC)

- General
1.1 These GTC shall apply to the contractual relations that arise between the Provider and the Customer by concluding a course contract (hereinafter referred to as the “Contract”) and shall form part of any contract concluded between the parties. The Customer may be both natural persons and legal entities.
1.2 By completing the order form “Order” and confirming that he/she has read these GTC (hereinafter referred to as “Order”), the Customer accepts these GTC of the Provider, which form an integral part of each Contract and are permanently accessible on the Provider’s website.
1.3 In addition to the general provisions of Act No. 40/1964 Coll., the contractual relations (as well as other legal relations that may arise from the contractual relationship) with natural persons who are not acting within the scope of their business activity when concluding a contract of which these GTCs are a part shall be subject to the general provisions of Act No. 40/1964 Coll. 102/2014 Coll. on consumer protection for the sale of goods or provision of services under a distance contract or a contract concluded outside the Provider’s premises and Act No. 250/2007 Coll. on consumer protection.
1.4 The provisions of Act No. 513/1991 Coll., the Commercial Code, as amended, apply to contractual relations (as well as other legal relations that may arise from the contractual relationship) with legal entities or natural persons – entrepreneurs.
1.5 The Customer is any person (natural or legal person) who has filled in and submitted an order via the Provider’s website, received an email notification of receipt of the order and paid the agreed price.
1.6 Order means an order form completed and submitted by the Customer.
1.7 The Order Form contains information about the Customer and the course ordered (the “Product”). An invoice will be issued to the Customer in advance of the Order, payable within 2 weeks of booking, and sent to the Customer together with an acknowledgement of receipt of the Order to the email address specified in the Order.
1.8 For the purposes of these Terms and Conditions, Product means all Courses.
- Product Order – Contract Conclusion
2.1 Product ordering is possible on the website www.upskill.vet
2.2 The electronic order of products made after completion of the order form and the subsequent payment of the price in accordance with the advance invoice sent shall constitute a proposal for the conclusion of a contract by the Customer. The price shall be deemed to be paid on the date on which the funds are credited to the Provider’s account.
2.3 Acceptance of the order of the products by the provider and thus the conclusion of the contract occurs on the basis of a written confirmation (electronically) of receipt of the order and confirmation of the credit of the price to the provider’s account, whereby the provider also informs the customer that the product has been paid for and the place on the course has been secured. Applications for courses are registered in the order of payment, as the number of participants per course is limited. Upskill.vet reserves the right to refuse registration without further explanation.
2.4 In the case of an order via the order form, the ordering party is always obliged to pay the price to the provider in advance, otherwise no contract will be concluded. The minimum number of participants per course is 8; if this number is not reached, Upskill.vet reserves the right to cancel the course and refund the money in full or to offer an exchange course on a different or the same topic in a different language (English).
Registration closes 4 weeks before the course in question, unless otherwise stated. Upskill.vet reserves the right to close registration at any time prior to the course.
2.5 The contract is concluded for a definite term and expires upon fulfilment of the obligations of the provider and the customer.
III. Price and payment terms
3.1 The price of the products ordered through the portal (hereinafter referred to as “price”) is always generated specifically for each individual customer after filling in the order on the provider’s website www.upskill.vet.
3.2 The Provider does not guarantee the temporal validity of prices in the event of the same order in any period of time. For the avoidance of any doubt, the price generated for a particular order shall not change once it has been paid within the due date.
3.3 The basic currency of payment is the euro. Currently, we only accept payments by bank transfer.
- Terms and conditions
4.1 Course conditions:
The Provider reserves the right to postpone the start date of the agreed course in situations and for reasons beyond its control (e.g. force majeure, interruption of the electricity supply to the course premises, sudden and unexpected incapacity of the lecturer). The Provider is obliged to inform the Client or all participants of the course immediately after becoming aware of such a situation and to propose and agree on an alternative date for the course. The provider may offer the client, subject to his/her interest, by mutual agreement and in addition to the price already paid according to the concluded contract, an individual course, which will be reasonably shortened in time due to the individual approach while maintaining the quality level, given that the lecturer is individually dedicated to the client for the entire duration of the course. If the client is not interested in the individual course, the provider will offer other alternative dates for the course. If none of the proposed start dates is suitable for the course, the provider will refund the amount paid for the course.
4.2 Conditions for cancellation of participation by the Customer:
Any participant wishing to cancel their booking must inform Upskill.vet at info@upskill.vet
Cancellation fees will be charged as follows:
No refunds will be given for cancellations received less than 4 weeks (32 days) prior to the course date, non-attendance or cancellation during the course.
For cancellations received between 8 to 4 weeks (56-32 days) prior to the course, Upskill.vet reserves the right to withhold 50% of the payment received.
Cancellations made more than 8 weeks (more than 56 days) prior to the course start date will be refunded in full less administrative costs (100 EUR).
Course fees will be fully refunded if the course is cancelled by Upskill.vet. No further claim can then be made; Upskill.vet will only refund the course fees in this case and will not reimburse the participants’ travel expenses.
Annual/monthly recurring fees, mentoring fees and exam fees for certification programs are non-refundable.
Upskill.vet does not provide refunds for payments made to third parties (hotels, airlines, transportation industry, etc.).
Upskill.vet recommends that participants purchase travel insurance in case of unexpected costs caused by events such as illness, strikes or other circumstances that may prevent the participant from attending the course.
4.3 Securing a place on the course:
A place on the course is only secured upon payment of the price stated in the advance invoice by the due date. In the event that the fee is not paid by the due date, the provider may offer the place to the next interested party.
4.4 Change of tutor:
The Provider reserves the right to change the tutor/lecturer. The change may be short term or permanent. The participant shall not be entitled to any refund or other compensation for the course.
4.5 Exclusion of Participant from Class:
In the event that a participant is disruptive, disruptive, disruptive or otherwise disruptive during the course or training session, the participant will be immediately excluded from the course or training session at the instigation of the tutor(s). He/she will not be allowed further access to the training room. The participant shall not be entitled to any refund of the price already paid or any aliquot amount.
If the participant arrives at the class ill in such a way that he/she could infect others present with his/her illness (i.e. showing obvious signs of illness: coughing, sneezing, sniffling or saying he/she is ill), he/she will be immediately excluded from the class. The provider may give the participant the opportunity to take the missed classes in another open course. The participant shall not be entitled to any refund of the price already paid or of any aliquot amount.
4.6 Liability:
Upskill.vet shall not be liable for any personal injury, loss or damage to the Participant’s personal belongings and property during the course or training. It is the responsibility of each participant to look after his/her personal property and not to leave it unattended. Upskill.vet may provide online lectures. Lectures not attended may not be offered at other times. Upskill.vet does not provide individual insurance for attendees. Course participants are required to have valid health insurance or other appropriate travel insurance. Any hands-on work with biological materials and instruments (e.g., surgical power tools, sharps) performed at Upskill.vet is at the participants’ own risk. All Upskill.vet course dates, locations and structure are subject to change up to 6 weeks prior to the start of the courses. Upskill.vet does not accept responsibility for monetary losses paid by participants to other organisations (e.g. travel, accommodation etc.).
- Withdrawal of the Customer from the Contract
5.1 The Customer may not withdraw from a contract, the subject of which is: the provision of services related to leisure activities and according to which the Seller undertakes to provide these services at the agreed time or within the agreed period.
5.2 The statutory conditions of the Commercial Code shall apply to the withdrawal from the contract by business customers.

- Complaints
In case of dissatisfaction of the Customer with the professional level of the lecturer or with the manner of conducting the course or due to a situation beyond the control of the Provider, the Customer must describe and justify such complaint to the Provider as a complaint on the first day of the course, within three hours of the start of the course at the latest.
If the conditions for this are created, by mutual agreement between the provider and the candidate, the provider may assign the candidate to another tutor on an alternative date of the course.
The provider will not accept any complaints, complaints or complaints from the candidate after this period, but may consider them individually.
The procedures set out in this Article shall also apply mutatis mutandis to the submission of a complaint or complaint by the Client.
VII. Copyright
All materials provided by Upskill.vet as part of its courses (including course notes or other teaching materials prepared by course tutors) are, unless otherwise stated, the property of Upskill.vet and the respective tutors.
Copyright and other intellectual property laws protect these materials.
Reproduction or transmission of the materials, in whole, in part or by any means, is not permitted without the prior written permission of the copyright holder.
Participants may not distribute any copies to third parties, whether or not in electronic form, for a fee or other consideration, without the prior written permission of the copyright holder of the materials.
Any violation of the above is a violation of copyright law and will result in exclusion from all future Upskill.vet courses without refund – and further prosecution will follow.

VIII. Privacy Policy
Provider fully respects the confidentiality of the information you fill in your order and provide to Upskill.vet Ltd. The data is secured and protected against misuse. We use them to carry out the entire transaction, including the necessary accounting operations, issuing tax documents, identifying your non-cash payments and to communicate with you, i.e. all customer administration and also for marketing purposes. This data is stored in a database with strict security against misuse.
